Lockheed Fights For Shooting Death Defense Costs In 3rd Circ.

Law360, New York (December 18, 2012, 4:42 PM EST) -- Lockheed Martin Corp. urged the Third Circuit on Monday to overturn a Pennsylvania federal judge's ruling that it's not entitled to recoup legal fees from security subcontractor U.S. Security Associates Inc. in a wrongful death suit over a 2008 workplace shooting.

In a reply brief to the Third Circuit, Lockheed asserts the contract under which it hired U.S. Security to guard its Archbald, Pa., facility does not include “indemnity-defeating” language allowing the subcontractor to dodge Lockheed’s legal fees and other costs from the litigation.
