GSK Tells 3rd Circ. Thalidomide Row Belongs In Fed. Court

Law360, New York (December 20, 2012, 5:58 PM EST) -- GlaxoSmithKline PLC urged the Third Circuit on Wednesday to keep in federal court a suit alleging it hid evidence that morning sickness drug thalidomide caused birth defects, arguing that the company is entirely based in Delaware.

The pharmaceutical giant claims “settled and bright-line rules” for establishing corporate citizenship justify a federal court's decision not to remand to Pennsylvania state court a suit brought by two people born with birth defects allegedly caused by thalidomide.
