Fla. Court Clears $15M Engle Win Against Lorillard

Law360, Los Angeles (December 21, 2012, 4:09 PM EST) -- A Florida appeals court on Friday affirmed a $15.2 million judgment against Lorillard Tobacco Co., ruling that the lawsuit brought on behalf of a smoker who died from lung cancer was properly litigated as an Engle progeny case.

The appeals panel upheld the award of $3.9 million in compensatory damages and $11.3 million in punitive damages for Michelle Mrozek, who brought wrongful the death suit against Lorillard for the 1994 death of her mother, Jacqueline Swann Miller, a two-pack-a-day smoker.
