The Split On FDA Requirement Of Graphic Smoking Warnings

Law360, New York (January 10, 2013, 12:56 PM EST) -- The 2009 Family Smoking Prevention and Tobacco Control Act authorizes the U.S. Food and Drug Administration to regulate tobacco products, including requiring new warning labels on cigarettes and smokeless tobacco. The new warnings on packaging and advertising of tobacco products require tobacco manufacturers — depending on the type of product — to reserve 20 to 50 percent of the package for full-color, graphic health warnings. The mandate specifically requires that 50 percent of cigarette packaging, 30 percent of smokeless tobacco packaging and 20 percent of tobacco advertising be reserved for the warning labels.
