Defense Groups Support KBR Appeal Over Iraq Food Contract

Law360, New York (January 3, 2013, 8:13 PM EST) -- The National Defense Industry Association and Professional Services Council filed an amicus brief in the Federal Circuit Wednesday in support of KBR Inc.'s appeal of a ruling that the U.S. could retroactively refuse to pay costs for food delivered to soldiers in Iraq because they were later deemed unreasonable.

The trade groups said the Court of Federal Claims' April ruling, which granted KBR only $11.8 million of the $41 million in unpaid costs under the contract, could set a poor precedent for contractors whose prices rise...
