Va. High Court Flips Ford, Honeywell Asbestos Verdict

Law360, Chicago (January 10, 2013, 7:45 PM EST) -- Virginia's highest court reversed a jury verdict Thursday against Honeywell International Inc. and Ford Motor Co. over the death of a man who was allegedly exposed to asbestos from brakes made by a Honeywell predecessor for Ford cars, finding the trial court improperly rejected the companies' jury instruction challenge.

Explicitly ruling for the first time on what causation standard is appropriate for mesothelioma cases, the state Supreme Court wrote that "in concurring causation cases, the 'sufficient'-to-have-caused standard … is the proper way to define the cause-in-fact...
