Lululemon Loses Bid To Trademark Large Version Of Logo

Law360, New York (January 14, 2013, 2:13 PM EST) -- The U.S. Patent and Trademark Office ruled Friday that exercise apparel company Lululemon Athletica Canada Inc. could not trademark a large version of its wave design for use on hooded sweatshirts and jackets, saying the design was ornamental and didn't deserve protection.

The USPTO Trademark Trial and Appeal Board affirmed an examiner's ruling that the Lululemon design was “mere ornamentation” and was too distinct from its trademarked logo for the two designs to “create the same commercial impression.”
