NLRB Allows Cos. To Shell Out Front Pay To Fired Workers

Law360, New York (January 16, 2013, 4:59 PM EST) -- The National Labor Relations Board’s acting general counsel issued a memo last week changing longstanding agency policy to permit companies to shell out front pay to employees who were wrongfully terminated, rather than reinstating them, in board settlements.

Under prior agency policy, a board settlement cannot include front pay in exchange for a waiver of reinstatement, so employers looking to strike such deals must do so through a nonboard settlement.
