Judge Won't Toss Suit Over Citibank Debit Card Overdrafts

Law360, San Francisco (January 18, 2013, 3:52 PM EST) -- A California federal judge on Friday refused to throw out a proposed class action accusing Citibank Inc. of fraudulently charging customers overdraft fees on debit card purchases, saying Citibank’s argument that customers had to file a complaint with the bank within 30 days of each charge was unreasonable. 

Citibank urged U.S. District Court Judge Charles Breyer to rule in its favor in customer Ronald Arendas' overdraft-fee case, arguing that he should have followed the complaint procedures outlined in documentation that came with his debit card. But...
