1st Circ. Affirms Toss Of $1.7M Award In Mass. Cleanup Suit

Law360, New York (January 22, 2013, 3:27 PM EST) -- The First Circuit on Friday denied a bid by National Grid PLC to reinstate a $1.7 million judgment against it in an environmental cleanup dispute with Century Indemnity Co. over pollution caused by gas production activities stretching back more than a century.

Boston Gas Co., which operates as National Grid, sought to challenge a Massachusetts district court ruling that vacated the $1.7 million verdict as inconsistent with post-trial guidance from the Massachusetts Supreme Judicial Court allowing insurance companies to take advantage of pro rata damages.
