SD High Court Backs Air Quality Permit For $10B Refinery

Law360, New York (January 24, 2013, 1:11 PM EST) -- A proposed $10 billion Hyperion Refining LLC oil refinery cleared a major roadblock Wednesday when the South Dakota Supreme Court affirmed the approval of an air quality permit that had been challenged by environmental groups.

The court determined that the state’s Board of Minerals and Environment did not err in awarding an air quality permit required for the construction of the 400,000-barrel-a-day Hyperion Energy Center that had been challenged by various environmental groups including the Sierra Club.
