Law360, New York (November 28, 2007, 12:00 AM ET) -- In the optical drive makers' patent battle, a California federal court has swatted down Asustek Computer Inc.'s bid to toss one patent from the suit and refused Ricoh Co. Ltd.'s request for a stay pending a related appeal.
Judge Marilyn Hall Patel's ruling allows the case to move forward with most of the claims involving all four patents intact.
The northern California litigation stems from the companies' involvement in a similar suit in western Wisconsin. That suit is still pending against a handful of other defendants....
