Fed. Circ. Rips Anvik Founder's 'Waffling' In $1.8B Patent Suit

Law360, Washington (February 6, 2013, 4:13 PM EST) -- A Federal Circuit panel on Wednesday criticized Anvik Corp. for failing to disclose prior patented technology as the best application of microlithography patents it claims Nikon Corp. has infringed, saying Anvik's founder's confusing deposition and contradictory evidence muddled its $1.8 billion patent case.

The company maintained during oral arguments Wednesday that its case shouldn't have been thrown out and its three patents shouldn't have been invalidated at the summary judgment stage because there were still significant factual disputes that should have gone to a jury. But...
