Prudential Escapes Suit Over 'Worthless' Wartime Policies

Law360, Los Angeles (January 29, 2013, 8:25 PM EST) -- A New Jersey federal judge on Tuesday dismissed claims by a proposed class of former defense contractor workers who said their employers and Prudential Insurance Co. of America sold them policies that were worthless because of a wartime exclusion, saying the claims are preempted by the Employee Retirement Income Security Act.

Tuesday’s decision marks an end to the putative class action filed in May against Prudential and affiliates of British defense contractor QinetiQ Ltd. for allegedly committing consumer fraud under New Jersey state law. The suit...
