8th Circ. Lets Insurer Off Hook For Forklift Co.'s Defense

Law360, New York (January 30, 2013, 6:18 PM EST) -- The Eighth Circuit on Wednesday upheld a lower court's ruling that Universal Underwriters Insurance Co. owes no coverage to a forklift retailer facing personal injury litigation because the company breached a cooperation clause in its policy.

Heubel Materials Handling Co. Inc. and Raymond Corp. had appealed the district court's order granting summary judgment to Universal on Heubel's claim for coverage under a Universal policy, but a three-judge Eighth Circuit panel nixed the companies' arguments.
