Fed. Circ. Could Restrict Timing Of Patent Appeals

Law360, New York (February 4, 2013, 9:23 PM EST) -- The full Federal Circuit will hear arguments Friday in a dispute between rival windshield wiper makers that could limit the ability of a patent litigant to file multiple appeals by separately challenging an infringement finding before damages or willfulness is decided.

Sitting en banc, the court will decide whether to allow Pylon Manufacturing Corp.'s appeal of a ruling that it infringed Robert Bosch LLC's patents. The automotive aftermarket supplier is challenging the decision before the trial court has ruled on damages or willfulness.
