Fed. Circ. Urged To Rekindle Fire Chopper Bid Protest

Law360, New York (February 5, 2013, 5:25 PM EST) -- Government contractor Croman Corp. asked the Federal Circuit on Monday to reinstate its $130 million bid protest over helicopters for fighting forest fires, arguing that the U.S. Forest Service's evaluation process was flawed.

Croman told the appeals court that the U.S. Court of Federal Claims was wrong to find that the trade-offs the Forest Service made among various factors in its evaluation, including between price and technical specifications, hadn't harmed Croman or led to its inability to secure any part of a 30-helicopter procurement.
