DOL Defends New H-2B Visa Wage Rule In 3rd Circ.

Law360, New York (February 6, 2013, 7:35 PM EST) -- The U.S. Department of Labor on Tuesday urged the Third Circuit to uphold the agency's new prevailing wage rules for the H-2B visa program in the face of a challenge to its authority to issue the regulations from industry groups. 

Groups representing employers in the logging, hotel, carnival, sugar cane and commercial crawfish industries are appealing a Pennsylvania federal judge's summary judgment ruling that the rule updating the minimum wage requirements for foreign workers on H-2B visas issued by the DOL in 2011 was valid....
