Smithfield Wins Review In Pork Plant Walkout Case

Law360, New York (December 5, 2007, 12:00 AM EST) -- An appeals court has agreed to review a case claiming that Smithfield Packing Co. Inc. violated national labor laws by allegedly threatening, beating and falsely arresting independently contracted cleaning employees at a hog-slaughtering production facility in rural North Carolina.

A three-judge panel in the U.S. Court of Appeals for the Fourth Circuit said on Wednesday that because the employees in question "strayed into the realm of unprotected activity" by walking off of the job, Smithfield’s petition for review must be granted.
