Texas Appeals Court Nixes $10M Award Against Fen-Phen Atty

Law360, Houston (February 28, 2013, 4:58 PM EST) -- A Texas appeals court said Thursday that faulty testimony led it to toss a jury’s verdict that had resulted in awards exceeding $10 million to 600 former clients who said a personal injury attorney had overcharged them in litigation against a Pfizer Inc. unit over the diet drug fen-phen.

The Fourteenth District Court of Appeals ruled that testimony of a legal ethics expert in a test case against attorney George Fleming “crossed the border of admissibility."
