DC Circ. Says Polar Bear Threatened Status Justified

Circuit on Friday backed the U.S. Fish and Wildlife Service’s designation of polar bears as a threatened species, rejecting a challenge brought by both industry and environmental groups after finding the agency made no errors in reaching its decision.

In upholding a Washington, D.C., district court ruling, the appeals court rejected arguments that the agency relied on defective population models, misapplied relevant terms, failed to adequately explain its decision-making process and committed various other errors in reaching its listing decision.
