OFCCP Nixes Pay Standards For More Open-Ended Approach

Law360, New York (March 4, 2013, 9:57 PM EST) -- The Office of Federal Contract Compliance Programs on Thursday formally rescinded its Bush-era guidelines for evaluating the fairness of contractors' pay practices, replacing its statistics-heavy approach with a more open-ended strategy that fits better with its aggressive pursuit of pay discrimination settlements.

The OFCCP, which enforces contractors' equal employment obligations, announced its decision Feb. 26, and the new policy became effective two days later, eliminating what the agency called “a rarely used, ineffective and burdensome compliance procedure."
