5th Circ. Backs Playboy In Licensing Feud With Distributor

Law360, Los Angeles (March 5, 2013, 10:26 PM EST) -- The Fifth Circuit on Tuesday upheld a district court’s ruling in favor of Playboy Enterprises Inc. in a suit alleging a Spanish-language distributor violated a licensing agreement with the publisher, finding the agreement enforceable and unambiguous.

The dispute arises from an agreement Playboy reached with Editorial Caballero SA, owned by Javier Sanchez-Campuzano, to publish Spanish-language editions of Playboy magazine and distribute them in Mexico and the U.S. That agreement involved a joint venture between EC and Grupo Siete International Inc., according to court documents.
