6th Circ. Revives H&R Block Customers' Stolen Identity Suit

Law360, Chicago (March 6, 2013, 4:56 PM EST) -- The Sixth Circuit on Wednesday revived six HRB Tax Group Inc. customers' claims that the company negligently safeguarded their information and negligently hired and supervised a tax preparer with criminal convictions who allegedly stole their identities.

The three-judge appellate panel concluded that Michigan courts, applying state law, would find that the H&R Block Inc. unit "owed a duty of care to safeguard the plaintiffs' confidential identifying information in this instance because of the special relationship between taxpayer and tax preparer."
