WealthTV Asks 9th Circ. To Reverse FCC Cable Decision

Law360, Los Angeles (March 7, 2013, 5:52 PM EST) -- The Ninth Circuit expressed doubts Thursday about WealthTV's claim that the Federal Communications Commission wrongly used vague standards in approving a decision by Comcast Corp. and other cable providers spurning WealthTV's programming in favor of shows from a provider-affiliated rival.

A three-judge panel questioned WealthTV's contention that the FCC and an administrative law judge were improperly guided by Michael Egan, an expert for Time Warner Cable Inc., who distinguished the network from MOJO, a rival programmer affiliated with the cable companies.
