8th Circ. Strikes Down DOL Mine Safety Enforcement Policy

Law360, New York (March 8, 2013, 7:51 PM EST) -- The Eighth Circuit on Friday found that a U.S. Department of Labor division overstepped its authority when it fined Northshore Mining Co. for violating federal safety rules, concluding that the company took the necessary precautions to protect its workers during equipment maintenance.

The appeals court said that the DOL's Mine Safety and Health Administration misinterpreted federal law when one of its inspectors issued a citation against Northshore, overturning a decision from the Federal Mine Safety and Health Review Commission.
