USPTO Draws Line On Discovery In Inter Partes Reviews

Law360, New York (March 11, 2013, 7:40 PM EDT) -- Saying it ran afoul of the strict limits on discovery in inter partes reviews, a U.S. Patent and Trademark Office panel has rejected Cuozzo Speed Technologies LLC's bid for information from Garmin International Inc. in a review of a Cuozzo speed limit warning patent.

The new inter partes review procedure created by the America Invents Act allows for much less discovery than is available in district court in order to make the reviews a cheaper and faster alternative to litigation.
