UPS Beats Suit Over Late Deliveries In 2nd Circ.

Law360, New York (March 11, 2013, 2:10 PM EDT) -- The Second Circuit on Friday upheld the dismissal of a proposed class action alleging United Parcel Service Inc. failed to deliver packages on time, saying the company's service guarantee contract did not obligate UPS to deliver packages on time or give a refund.

Adam Starke, a UPS customer whose package from New York City to Albany, N.Y., was delayed because of a snow-related backlog at the company, claimed UPS should extend a refund normally provided for customers whose packages are delayed because of foreseeable weather....
