Pa. High Court To Hear Appeal On Coal Mine Safety Law

Law360, Philadelphia (March 11, 2013, 6:52 PM EDT) -- The Pennsylvania Supreme Court announced Monday that it would hear a challenge by the state Department of Environmental Protection to a lower court ruling that concluded the agency lacked the authority to impose added safety requirements on mine operators.

The DEP is appealing a decision initially made by the state Environmental Hearing Board, which was then upheld by the Commonwealth Court in 2011 under the Bituminous Coal Mine Safety Act, favoring Amfire Mining Co. LLC, Cumberland Coal Resources LP and Emerald Coal Resources LP.
