DC Circ. Rules FDA Properly Approved Skin Oil Generics

Law360, New York (March 12, 2013, 3:01 PM EDT) -- The D.C. Circuit on Tuesday affirmed that the U.S. Food and Drug Administration had acted within its authority when it approved generic versions of Hill Dermaceuticals Inc.’s Derma-Smoothe psoriasis and dermatitis treatments, despite Hill’s argument that the agency had abused its discretion.

According to the three-judge panel, U.S. District Judge Royce C. Lamberth had correctly found that the FDA had properly followed the Food, Drug and Cosmetic Act when approving Identi Pharmaceuticals Inc.’s abbreviated new drug applications to make generic body, scalp and ear oil-drop versions...
