9th Circ. Refuses To Rehear ATM Fee Antitrust Case

Law360, New York (March 14, 2013, 6:42 PM EDT) -- The Ninth Circuit refused Wednesday to reconsider its ruling that a group of bank customers were indirect purchasers who lacked standing to sue Bank of America NA, JPMorgan Chase Bank NA and others for allegedly price-fixing ATM interchange fees.

Though the July decision affirming the dismissal of the proposed class action was unanimous, one of the judges on the panel that heard the case recommended that the court reconsider its ruling.
