DMCA Shields Veoh From Copyright Claims, 9th Circ. Rules

Law360, New York (March 14, 2013, 9:26 PM EDT) -- The Ninth Circuit ruled Thursday that the Digital Millennium Copyright Act protects video-sharing site Veoh Networks Inc. from copyright claims by Universal Music Group Inc., holding that the site did not know of the infringement and couldn't control it.

The appeals court previously ruled in Veoh's favor in 2011, but decided to rehear the case after the Second Circuit used a somewhat different interpretation of the DMCA's safe harbor provision in a decision last year involving Google Inc.'s YouTube.
