RJ Reynolds Asks 2nd Circ. To Snuff Ex-Smoker's $24M Verdict

Law360, New York (March 18, 2013, 6:06 PM EDT) -- R.J. Reynolds Tobacco Co. on Monday asked the Second Circuit to throw out a $24 million court win for a woman who claims smoking the company's cigarettes gave her throat cancer, arguing there is no solid evidence of a link.

Tests cannot pinpoint the exact reason cancer strikes a particular person, and data on the throat cancer plaintiff Barbara Izzarelli was diagnosed with suggests that smoking was not responsible, a lawyer for Reynolds told a panel of judges at oral arguments in Manhattan.
