Samsung Hits Back At Ericsson In Patent Licensing Battle

Law360, New York (March 20, 2013, 3:31 PM EDT) -- Samsung Electronics Co. Ltd. countersued Ericsson Inc. in Texas federal court Monday over 12 telecom patents, alleging Ericsson — "unhinged" by its exit from the mobile device market — has refused to license its standard-essential telecom patents on fair terms.

Samsung alleges Ericsson, which filed two lawsuits against Samsung in November, has spoiled two years of negotiations by refusing to renew a cross-license on Ericsson's telecom patent portfolio on fair, reasonable and nondiscriminatory terms, or FRAND, terms.
