2nd Circ. Kills Suit Against Disney Over 'Tinkerbell' Mark

Law360, New York (March 22, 2013, 7:03 PM EDT) -- A cosmetic company that had licensed the right to use the trademark "Tinkerbell" from a Dutch company cannot sue Walt Disney Co., which bought the mark for itself before the license ended, the Second Circuit ruled Friday.

A three-judge panel said that Icebox-Scoops Inc. cannot bring a lawsuit against Disney for allegedly interfering with a license agreement that it had with Netherlands-based Finanz St. Honore BV, which once owned the trademark on Tinkerbell.
