NJ High Court Snubs Bid To Up Eminent Domain Damages

Law360, New York (March 26, 2013, 3:57 PM EDT) -- The New Jersey Supreme Court has refused to second guess an appellate court decision that abandoned condemnation actions by Long Branch didn't amount to a temporary taking of homeowners' properties and that they weren't entitled to extra compensation.

In a decision made available Tuesday, the high court declined the homeowners' request to take up the appellate judgment, which clarified the damages that property holders are owed when eminent domain proceedings against them are dropped.
