ITC To Review Ruling In Sex Toy Knockoff Case

Law360, New York (March 26, 2013, 9:01 PM EDT) -- The U.S. International Trade Commission said Monday it would review a judge's ruling that the importation of allegedly infringing sex toys is not a Section 337 violation, in response to petitions by patent-holder Standard Innovation Corp. and the accused infringers.

ITC Administrative Law Judge Thomas B. Pender found that Standard Innovation had not satisfied the economic prong of the domestic industry requirement under Section 337 of the Tariff Act, the commission stated Monday.
