Pa. Supreme Court To Tackle Judges' Mandatory Retirement

Law360, New York (March 28, 2013, 6:59 PM EDT) -- The Pennsylvania Supreme Court agreed Thursday to exercise special jurisdiction to hear a pair of suits filed in the Commonwealth Court by state judges challenging a provision of the state constitution mandating that judges retire at the age of 70.

The state Supreme Court granted the judges’ applications for extraordinary relief, agreeing to take up the question of “whether article V, section 16 of the Pennsylvania Constitution violates applicants’ rights under Article I of the Pennsylvania Constitution” and ordered the two cases challenging the mandatory retirement...
