US Wins $10M Judgment For Illegal Primrose Oil Imports

Law360, Los Angeles (March 29, 2013, 4:19 PM EDT) -- The U.S. Court of International Trade on Thursday ordered Scottish company Callanish Ltd. to pay almost $10 million for importing evening primrose oil despite a U.S. Food and Drug Administration ban on the supplement, granting the government a victory after its multiple attempts at recovering a penalty.

The court had previously rejected the government's request for a $17.7 million judgment over the imports, which allegedly happened 52 times from 1988 to 1992, ruling the U.S. had wrongly appraised the domestic value of the dietary supplement. But...
