Appeals Court Boots Challenge To Dallas Payday Lending Law

Law360, Dallas (April 2, 2013, 2:25 PM EDT) -- A state appeals court on Monday threw out a lawsuit from the Texas unit of payday lending giant EZ Corp. that sought an exemption from a Dallas ordinance that restricts loan amounts on the grounds its lending activity is ancillary to its pawn shop business.

The court said Dallas has governmental immunity in the suit because Texas EZ Pawn LP, doing business as EZ Money, was only seeking a statutory clarification and not to invalidate the entire ordinance. EZ Money sued the city in March 2012,...
