Energy Cos. Seek To Bar State Antitrust Claim

Law360, New York (January 2, 2008, 12:00 AM EST) -- The energy giants accused of conspiring to raise and fix wholesale natural gas prices are pressing a federal court to bar the Wisconsin plaintiffs in the multidistrict litigation from bringing a claim under state antitrust laws.

Oneok Inc., Duke Energy and more than a dozen other energy companies submitted a court filing with the U.S. District Court for the District of Nevada on Dec. 26, contending that the plaintiffs do not have standing to bring a claim under Wisconsin’s “full consideration” antitrust statute.
