Fed. Circ. Wipes Out $600M Patent Judgment Against J&J

Law360, New York (April 4, 2013, 7:49 PM EDT) -- The Federal Circuit ruled Thursday that Johnson & Johnson didn't infringe a doctor's stent patent, throwing out a jury verdict against J&J and a damages award of nearly $600 million.

The appeals court ruled that U.S. Judge T. John Ward of the Eastern District of Texas misconstrued two key claims in a patent issued to radiologist Bruce N. Saffran and that under the correct claim construction, Cypher stents made by J&J's Cordis Corp. subsidiary do not infringe.
