Texas High Court Trims Access To Public Workers' Union Reps

Law360, Dallas (April 5, 2013, 3:11 PM EDT) -- Public employees in Texas don’t have the same right as federal public sector workers to request union representation at internal investigation interviews they expect would result in disciplinary action against them, the Texas Supreme Court said Friday.

In a 6-3 decision, the court held the Texas Labor Code doesn’t grant unionized public employees the same right to representation that federal public sector workers and all private sector workers enjoy and said a U.S. Supreme Court decision granting the right, NLRB v.
