Importer Owes More Damages In Milk Contract Row: 11th Circ.

Law360, New York (April 8, 2013, 8:02 PM EDT) -- The Eleventh Circuit on Monday ruled that Venezuelan company Bariven SA is entitled to more damages from Florida import-export company Exim Brickell LLC in a breach of contract dispute for certain shipments of powdered milk from China that Bariven rejected for being contaminated with melamine.

A three-judge panel ruled that Bariven gave proper notice to Exim in April 2009 that it was revoking acceptance of 16 shipments of powdered milk it learned were contaminated with melamine in the tainted Chinese milk scandal that erupted in September...
