Tribe Can't Bring Medical Monitoring Claims: Judge

Law360, New York (January 3, 2008, 12:00 AM EST) -- A court has ruled that the Quapaw tribe of North Dakota cannot bring medical monitoring claims against a group of mining companies that allegedly contaminated the tribe's land with hazardous pollutants.

The Quapaw tribe originally filed the lawsuit against a number of mining companies in 2003, alleging that a 40-square-mile site on its reservation, known as the Tar Creek site, had been contaminated with lead and other mining wastes that endangered the health of tribal members.
