Law360, New York (January 04, 2008, 12:00 AM ET) -- A federal appeals court has reversed a lower court's decision that cleared manufacturer Skyjack Inc. and lift owner Rental Services Corp. Inc. from liability for the death of a carpenter who died after a scissors lift he was operating tipped over.
The U.S. Court of Appeals for the Eighth Circuit found Friday that the district court should not have granted summary judgment to the companies targeted in the product liability suit and should have included relevant testimony by the plaintiffs' experts.
