Hershey, Mars Plotted To Fix Chocolate Prices: Suit

Law360, New York (January 7, 2008, 12:00 AM EST) -- Three separate lawsuits filed within the past month accuse The Hershey Co. and other top candy companies of participating in a conspiracy to artificially inflate the price of chocolate.

The putative class actions, filed in federal courts in Pennsylvania and New Jersey, allege that top chocolate makers Hershey Co., Mars Inc. and Nestle U.S.A., Inc., among others, colluded to fix prices for consumers and suppliers.

The New Jersey lawsuit was filed Dec. 21 by CNS Confectionery LLC and Winn Corp.
