Roche Urges Fed. Circ. To Revive Boniva Patents

Law360, New York (April 17, 2013, 7:01 PM EDT) -- Hoffmann-La Roche Inc. on Monday urged the Federal Circuit to overturn a ruling that found two patents covering its osteoporosis drug Boniva invalid for obviousness, part of a dispute with several generic-drug makers over their planned versions of the drug.

According to Roche’s brief, U.S. District Judge Stanley R. Chesler had mistakenly ruled that the company’s patents covering Boniva — U.S. Patent Numbers 7,718,634 and 7,410,957 — could have been anticipated based on studies involving lower doses of the drug and were thus obvious.
