Understanding Where And When To File A Claim

Law360, New York (April 17, 2013, 3:10 PM EDT) -- Federal Rule of Bankruptcy Procedure 5005 governs where a proof of claim should be filed. Electronic filing is permitted in many districts, but one must look to the local rules for the district in which the bankruptcy petition was filed. Similarly, local rules generally require service on all parties-in-interest, along with a filing of a certificate of notice. In some cases, there may be a third-party claims agent with whom to file proofs of claim in lieu of filing with the court.
