Judge Overturns Willfulness Verdict Against ESpeed

Law360, New York (January 8, 2008, 12:00 AM EST) -- Citing the "new standard" set by the Seagate case for determining willful infringement, a federal judge has overturned the part of a jury verdict against eSpeed Inc. that found it had willfully infringed Trading Technologies International Inc.'s patented method for placing trade orders online.

Judge James B. Moran of the U.S. District Court for the Northern District of Illinois on Thursday granted eSpeed's motion for judgment as a matter of law that its conduct was not willful, and he denied Trading Technologies' motion for enhanced damages....
